Coverage: Protean Developing LLC dba Anew Remodeling (hereinafter referred to as "the Company") provides a 1-year limited warranty on all residential renovation and remodeling work performed. This warranty covers defects in workmanship for a period of one year from the date of substantial completion of the project.
Warranty Coverage
- Defects in Workmanship: The Company warrants that all work performed will be free from defects in workmanship for a period of one year from the date of project completion. If any defect is discovered within this period, the Company will repair or replace the defective work at no additional cost to the client.
- Manufacturers' Warranty: Any defects in materials are covered by the manufacturers' warranties. The manufacturers' warranties supersede this workmanship warranty. Clients are responsible for any warranty claims related to material defects directly with the manufacturer.
Exclusions
This warranty does not cover the following:
- Ice build-up in gutters and on roofs which cause interior leakage (unless arising from the Company's failure to adhere to the Contract Documents).
- Stopped-up plumbing, sewers and drains caused by Owner/s or occupant.
- Any and all nicks, scratches, chips, dents or marks in cabinets, countertops, fixtures, woodwork, mirrors, glass, aluminum siding, vinyl or wood siding, not noted at the final inspection.
- Minor cracks (less than 1/16th inch) in exterior stucco, rough sawn cedar, or prefinished siding; and separation of joints necessary for proper construction purposes.
- Any damage to the extent it is caused or made worse by: negligence, improper maintenance or improper operation by anyone other than the Contactor, its employees, agents or subcontractors; failure of anyone other than the Company, its employees, agents or subcontractors to comply with the warranty requirements of manufacturers of appliances, equipment or fixtures; failure to give notice to the Company of any defect within a reasonable time; or changes in grading of the ground by anyone other than the Company, its employees, agents or subcontractors.
- Normal wear and tear; that is, any damage or wear that occurs naturally over time through normal usage is not covered by this warranty.
- Loss or damage from events of casualty not caused or made worse by the failure of the Company, its employees, agents or subcontractors to adhere to the Contract Documents.
- Any defect caused by soil movement.
- Insect damage.
- Any loss or damage, which arises while the Residence is being used primarily for non-residential purposes.
- Acts of God and Natural Disasters: Damage caused by events beyond human control, such as storms, floods, earthquakes, or other natural disasters.
- Intentional Destruction: Any damage resulting from intentional acts of destruction or vandalism by the client or any third party.
- Work by Other Contractors: Any defects or damages resulting from work performed by other contractors after the completion of the project by the Company.
- Malicious, Abusive, or Unreasonable Conduct: Any damage resulting from malicious, abusive, or unreasonable conduct by the client or any third party.
Additional Clauses
- Transferability: This warranty is issued exclusively to the original client and is non-transferable. Any transfer of ownership of the property voids this warranty.
- Client Maintenance Responsibilities: The client is responsible for routine maintenance and care of the work performed. Failure to maintain the work as per the provided guidelines may void this warranty.
- Access for Inspection: The client must provide reasonable access to the property for the Company to inspect the claimed defect.
- Repair Process: If a defect covered by this warranty is found, the Company will repair or replace the defective workmanship within a reasonable time frame. The choice between repair or replacement is at the discretion of the Company.
- Third-Party Products: Any third-party products, fixtures, or materials installed as part of the renovation or remodeling work are subject to their respective manufacturers’ warranties. The Company is not responsible for any defects or issues related to these third-party products.
- Extent of Repairs: The Company’s obligation to repair or replace defective workmanship does not extend to any incidental or consequential damages or expenses incurred by the client.
- Building Codes and Regulations: All work performed by the Company is in compliance with local building codes and regulations. Any modifications or repairs requested by the client must also comply with these standards.
- Amendments: This warranty constitutes the entire agreement between the Company and the client. Any amendments or modifications to this warranty must be in writing and signed by both parties.
- Severability Clause: If any provision of this warranty is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Claim Process: To make a warranty claim, the client must notify the Company in writing within the warranty period. The notification must include a detailed description of the defect and any relevant supporting documentation. The Company will inspect the defect and determine the appropriate course of action. Repairs made under this warranty are warranted for the remainder of the original warranty period. Performing a repair does not reset or extend the original warranty period.
Limitations of Liability: The Company’s liability under this warranty is limited to the repair or replacement of the defective workmanship. The Company shall not be liable for any indirect, incidental, or consequential damages arising from any defect covered by this warranty.
Governing Law: This warranty shall be governed by and construed in accordance with the laws of the state of Texas. Any disputes arising from this warranty shall be resolved in the courts of Texas.
